DEVELOPMENT SERVICES Bylaws for Consideration of First Reading 9.1.1 Z 17-07, Zoning Amendment Bylaw No. 0154.59 and 0154.66, 2211 Campbell Road Recommended Motion: THAT Council give first reading to City of West Kelowna Zoning Amendment Bylaw No. 0154.59, 2018 (Z 17-07); and THAT Council give first reading to City of West Kelowna Zoning Amendment Bylaw No. 0154.66, 2018 (Z 17-07); and THAT Council direct staff to schedule the bylaws for Public Hearing subject to referral of the draft CD8 Zone to the Agricultural Advisory Committee and external agencies. DP 17-17 Development Permit and Development Variance Permit, 2301 and 2311 Carrington Road Recommended Motion: THAT Council authorize the issuance of a Development Permit (DP 17-17) to construct a four-storey apartment building (101 units) for Lot 1, DL 5057, ODYD, Plan 41637 subject to the conditions outlined in the attached Development Permit; and THAT Council authorize a variance to City of West Kelowna Zoning Bylaw No. 0154, as follows: ? That the maximum allowable building height specified in Table 11.1.5(e) be increased on the west elevation only from 15 m to 19.4 m in conformance with the attached Elevations, Sheet No. DP-3.3 to allow for an exposed parking garage; and ? That the minimum loading space dimension specified in Table 4.11 be decreased from the Truck/Van type size (3.0 m x 9.0 m) to the Car type size (2.5 m x 7.0 m) for two of the five required loading spaces in conformance with the attached Garage Plan Level P2, Sheet No. DP-2.3; and THAT issuance of the Development Permit be withheld pending: ? confirmation of the release/discharge of Restrictive Covenant LB245962 to accommodate the proposed retaining walls and landscaping within the existing No Build covenant area; and ? receipt of security for the landscape plan in the amount of $146,142.48; and THAT if the Development Permit has not been issued within one year from the date of approval, the Permit shall be deemed to have been refused and the file closed.
DVP 18-04, Development Variance Permit, 3077 Stoneridge Drive Recommended Motion: THAT Council support the issuance of a Development Variance Permit (DVP 18-04) for 3077 Stoneridge Drive to vary Section 4.2.2(a) Zoning Bylaw No. 0154 to reduce the required length of two parking stalls from 6.0 metres to 4.99 metres in accordance with the attached permit.
DVP 18-06, Development Variance Permit, 3060 Seclusion Bay Road Recommended Motion: THAT Council support the issuance of a Development Variance Permit (DVP 18-06) for 3060 Seclusion Bay Road to vary Section 3.12.1 of Zoning Bylaw No. 0154 to increase the permitted height of a retaining wall from 2.5m (8.2ft.) to 9.0m (29.5ft.) in accordance with the attached permit.
TUP 18-02, Temporary Use Permit, Glenrosa Road Recommended Motion: THAT Council approve the issuance of a Temporary Use Permit (TUP 18- 02) for Lot 2, DL 3482, ODYD, Plan KAP67438 for the duration of 2018, expiring December 31, 2018, to permit the processing of raw materials (e.g. gravel crushing and screening) on a portion of the Glenrosa Road subject property in accordance with the attached permit (Attachment 1) and subject to: 1. Issuance of public notification as per the terms outlined in the Permit; 2. Activities approved under this Permit may only occur Monday to Friday between the hours of 7 am and 5 pm; 3. Delineation of the adjacent covenant area and nearby park area with orange snow fencing to ensure its protection; and 4. Regular site monitoring to ensure that the agreed upon processing location, proposed days and hours of operation, permitted trucking routes are maintained.

Revisions to City of West Kelowna Fire Rescue Establishment and Operations Amendment Bylaw No. 114 Recommended Motion: THAT Council give first, second and third reading to the “City of West Kelowna Fire Rescue Establishment and Operations Amendment Bylaw No. 0114.02, 2018”; and THAT Council give first, second and third reading to the “Bylaw Notice Enforcement Amendment Bylaw No. 0093.39, 2018”; and THAT Council give first, second and third reading to the “City of West Kelowna Ticket Information Utilization Bylaw No. 0095.38, 2018”.
Investing in Canada Green Infrastructure Environmental Quality Program Recommended Motion: THAT the City of West Kelowna apply to the Investing in Canada Green Infrastructure Environmental Quality Program requesting the maximum funding contribution of 73.33% of eligible costs to connect the Pritchard, Sunnyside and West Kelowna Estates Systems to the Rose Valley Water Treatment Plant; and THAT the Mayor and City Clerk be authorized to execute the agreement for a successful application; and THAT the 10-year capital plan be amended as required for a successful application.
2018 – 2027 Financial Plan Amendment Recommended Motion THAT Council increase legal expenses by $64,907.55 to fund emergent expenditures associated with the *REASONS FOR JUDGEMENT* KE S103086 – Justice McNaughton – Re: Klonteig v. West Kelowna (District), 2018 BCSC 124; and THAT Council amend the 2018-2027 Financial Plan to fund the legal expenses from the Claims Reserve.
Upgrade to Phone System and Paging/Sound System, Johnson Bentley Memorial Aquatic Centre Recommended Motion: THAT Council approve the amendment of the 2018 – 2027 Financial Plan to add $39,950 plus a 10% contingency ($3,995), plus pst ($3,076) for the upgrade to the paging and sound systems at Johnson Bentley Memorial Aquatic Centre and that the funding be taken from the Reserves for Future Expenditures.
